Supreme Court, in a supplemental judgment following a successful appeal from the High Court on a preliminary issue, awards the plaintiff 40% of the costs in all of the courts and on all of the motions, on the grounds that there had been extensive interlocutory wrangling and that the 'slate on costs should be wiped clean' in advance of a unitary trial in the High Court.
