Order for surrender to Poland granted where no abuse of process is established

High Court orders that the respondent be surrendered to Poland on foot of a European Arrest Warrant, on the grounds, inter alia, that it cannot be shown that any abuse of process has arisen, and the court is satisfied that the rights of the respondent have not been breached.

European arrest warrant (EAW) – European Arrest Warrant Act, 2003 – EAW issued by Regional Judge of Poland – seeks surrender to enforce sentence of 6 years and 6 months imprisonment – Respondent contested his surrender – submissions rejected – ordered that the respondent be surrendered to Poland - no abuse of process can be said to have arisen.
