High Court: (a) makes award of €150,000 in respect of damages for personal injuries arising from a serious assault by the plaintiff's former partner, where he kicked and head butted her face and neck causing eye injuries, skull fractures, damage to face requiring reconstructive surgery and post-traumatic stress disorder; but (b) does not make any award in respect of aggravated damages, on the grounds that the defendant had already been convicted and sentenced in a criminal court and it was not the function of a civil court to punish him.
Personal injuries - assault by former partner - assessment of damages - damage to eyes and face - bootmarks on neck and face - skull fractures - reconstructive surgery to face - medical evidence - aggravation of damages.
